AAI and Professors Urge Rule of Presumptive Illegality for Reverse Payments (In re K-Dur Antitrust Litigation)

AAI filed an amicus brief with 26 law, economics, and business professors urging the Third Circuit to adopt a standard of presumptive illegality for patent infringement settlements that involve payments by a branded drug maker to a generic challenger to delay entry into the market.  The brief was written by AAI Advisory Board Member Michael Carrier with the assistance of Advisory Board Member Ellen Meriwether and AAI Director of Legal Advocacy Rick Brunell.
