This article reviews the economic model used by DoJ in its recent challenge of the ATT-Time Warner Merger. As the judge noted, the implications of this model severely damaged the government’s case. We conclude that an alternate economic model was available that was both more in applicable to the circumstances of the case and also would not have had the same implications for the final outcome.
