AAI filed an amicus brief supporting the State of California in its challenge to a revenue sharing agreement used by supermarkets in Southern California as a weapon in a labor dispute. AAI urged the en banc Ninth Circuit to hold that the agreement was unlawful under the quick look doctrine because it is inherently anticompetitive and not supported by any legitimate procompetitive justification.
