AAI Urges Ninth Circuit to Use “Quick Look” to Strike Down Revenue Sharing Agreement Used in Labor Dispute (California v. Safeway)

AAI filed an amicus brief supporting the State of California in its challenge to a revenue sharing agreement used by supermarkets in Southern California as a weapon in a labor dispute.  AAI urged the en banc Ninth Circuit to hold that the agreement was unlawful under the quick look doctrine because it is inherently anticompetitive and not supported by any legitimate procompetitive justification.  The brief was written by AAI’s Director of Legal Advocacy, Rick Brunell.
