AAI will host its 22nd annual policy conference on June 15 and 16, 2021. The two-day, virtual conference, Competition Enforcement in the International Arena, will highlight new perspectives around ongoing and emerging international competition enforcement and policy concerns. The annual conference will appeal to a wide cross section of the competition community from the U.S. and abroad, including public and private enforcers, legislators and policymakers, public interest advocates, and sector regulators. The conference is scheduled from 11 a.m. – 1:30 p.m. Eastern on June 15 and from 11 a.m. – 1:45 p.m. Eastern on June 16. The conference includes three panels of noted past and present enforcers, practitioners, policymakers, and scholars, and a discussion about international issues with antitrust experts Frederic Jenny and William Baer.
PANEL DESCRIPTIONS:
Panel 1 – International Competition Policy: From Trump to Biden
The Trump Administration’s antitrust and regulatory agencies pursued several sweeping changes to U.S. competition policy both domestically and internationally. Whether through speeches, guidance or other forms of public commentary, Trump enforcers changed course on intellectual property policy, vertical mergers, cartel prosecutions, remedies, and much more. This panel will take stock of the Trump antitrust leadership’s most significant policy changes and consider the course likely to be charted by Biden antitrust and competition officials in 2021 and beyond.
Frederic Jenny and William Baer: A Conversation
A discussion about international issues with antitrust experts Frederic Jenny – Professor of Economics, ESSEC Business School, Paris; Chairman, Competition Committee, OECD – and William Baer – Former Assistant Attorney General for the Department of Justice Antitrust Division (2013-2016) and Visiting Fellow – Governance Studies, The Brookings Institution.
Panel 2 – International Perspectives on Privacy, Technology, and Competition
The intersection of competition and privacy concerns in the modern, data-driven digital economy is a seminal public policy issue of the modern era. Its ramifications are on full display in major pending monopolization cases against dominant technology firms, and in privacy and data-protection legislation being enacted, considered, or explored in major jurisdictions around the world. Factoring in the different legal, cultural and institutional contexts in which global enforcers and regulators operate only adds to the complexity of the issue. This panel will discuss the core privacy and competition challenges facing policymakers, regulators and enforcers in key jurisdictions around the world.
Panel 3 – The State of Global Cartel Enforcement
Despite Congressional reauthorization of ACPERA and strong commitments from the Antitrust Division, the continuing efficacy of cartel leniency programs has been called into question based on reports of rising costs of cross-border compliance. Meanwhile, the evolution of class action law in the United States, and the use of collective redress mechanisms abroad, portend important and related developments for cartel enforcement around the world. Focusing on these important issues and others, this panel will unpack the most pressing international cartel trends affecting public and private enforcers and cartel victims in the U.S. and abroad.
