This amicus brief was filed in the 11th Circuit for the AAI by volunteer attorney (and law professor) Paul Slater, who also wrote our amicus in the 6th Circuit’s hearing on the Cardizem appeal, there urging approval of the District Court’s holding that an agreement by a patent holder to pay a generic to stay out of market is per se illegal. This case presents a very similar situation involving the drug Terazosin Hydrochloride. See this link
