Leegin Creative Leather Products v. PSKS, Inc. (Validity of per se rule against RPM)
In an amicus brief to the Supreme Court, the AAI urged that the venerable per se rule against minimum resale price maintenance, the Dr. Miles precedent, not be overturned. If overruling is determined, the brief argues that minimum RPM be rebuttably presumed to be illegal.
The brief was authored by Richard Brunell, Senior Fellow and Director of Legal Advocacy for the AAI.
