The AAI Working Group on Civil Remedies has responded to a request by the Antitrust Modernization Commission for public comments concerning four proposals that could have a substantial (and we say very negative) impact on the private enforcement of antitrust. The proposals deal in various ways with indirect purchaser cases, treble damages, and follow-on’s to criminal convictions.
