On December 1, 2021, AAI’s Diana Moss spoke at the George Washington University Competition Law Center and Crowell & Moring’s Third Annual Antitrust and Tech Conference. Her panel, How We Got Here: What Prompted the Critique of U.S. Merger Enforcement Policy, explored the factors that have led antitrust enforcers and legislators to express concerns about the state of merger enforcement, particularly in digital markets. How will the digital markets industry change if antitrust enforcement increases? Will the effects of the increased enforcement drive tech companies to change their business models? This panel will explore how merger activity in digital markets, along with more general concerns for increased concentration, market power, and the perceived inadequacy of past merger remedies, have led to ramped up merger enforcement and the promise of revised horizontal and vertical merger guidelines in the US.
