Diana Moss participated in “Do “Fixes” Fix Anything?” panel on Antitrust Remedies at the annual meeting of ABA Section of Antitrust Law. The adequacy of remedies in mergers and other antitrust matters has stirred a fair amount of debate. The work of John Kwoka has raised questions about whether partial divestitures or behavioral remedies have prevented supracompetitive prices post-merger, while the Federal Trade Commission’s study of merger remedies found they were largely effective at maintaining competition. Assistant Attorney General Delrahim has indicated skepticism for behavioral remedies, and questions remain about partial divestitures. Moss was one of three leading experts on antitrust remedies who presented different points of view on the effectiveness of the antitrust agencies’ remedies and what the agencies should do going forward.
