This panel will address the increasing antitrust scrutiny on ESG agreements, particularly in finance and investment, with concerns over “climate cartels” and potential unintended consequences, as raised in recent congressional hearings. It will also cover the FTC’s expected reversal of the 2022 Policy Statement on Section 5 of the FTC Act, narrowing the definition of “unfair methods of competition.” Additionally, the panel will discuss the revocation of guidelines on safe data exchanges and the tightening scrutiny on competitor information sharing, with cases like Agri Stats and RealPage highlighting risks for companies using third-party data or pricing software.
