AAI’s Kathleen Bradish, Vice President and Director of Legal Advocacy, spoke about recent developments regarding the enforcement of Section 2 of the Sherman Act while the legal standards for monopolization and attempts to monopolize continue to be evaluated at the Philadelphia Bar Association’s program, Update on Developments Relating to Section 2 of the Sherman Act. From the description:

The Department of Justice (DOJ) has recently signaled a renewed focus on criminally prosecuting violations of Section 2 of the Sherman Act, a significant shift from its previous practice of nearly 50 years focusing primarily on civil enforcement or Section 1 violations. Companies, especially those in concentrated markets, need to be aware of this development and ensure compliance with antitrust regulations.

This CLE program will provide an update on Section 2 of the Sherman Act which focuses on monopolization, attempts to monopolize and conspiracies to monopolize. The update will address the American Antitrust Institute’s work regarding the Sherman Act, including most recently clarifying Aftermarket Monopolization Standards. The American Antitrust Institute is an independent, nonprofit organization devoted to promoting competition through research, education, and advocacy.
