This paper summarizes   the facts and competition issues, including the potential for   coordinated horizontal pricing among authors and publishers with Google   as the facilitator, the opportunities for Google to engage in   unilaterial anticompetitive conduct, and the appropriateness of a class   action settlement between private litigants as a vehicle for making   public policy. Peritz is a professor and Miller a student at the New   York Law School.
