IP and Innovation

Both intellectual property (IP) rights and antitrust are intended to foster innovation, which is a major contributor to economic growth and higher living standards. However, the protection of IP rights is sometimes in tension with the promotion of competition. The AAI seeks a balance between IP law and antitrustlaw and has focused on the role of standard setting organizations, patent ambush, pay-for-delay agreements, patent exhaustion doctrine, and the over-use of injunctions in certain infringement situations.
