Lande Analyzes Intel in February Issue of The CPI Antitrust Journal

AAI Director Robert L. Lande published an analysis of the "pure" Section5 allegations in the recent FTC complaint against Intel in the February 2010 issue of The CPI Antitrust Journal.  Available here, the analysis first shows that Section 5 of the Federal Trade Commission Act is more encompassing than the Sherman Act and why this breadth is in the public interest. Lande then reviews allegations from the Intel Complaint, showing why each appears to be in the public interest yet might not be permitted by the Sherman Act. He also discusses other advantages that would arise if these charges were litigated under Section 5 rather than the Sherman Act.
