Both intellectual property rights (IPR) and antitrust are intended to generate conditions conducive to innovation, which is a major objective of a market economy. However, the two can conflict and it is AAI's position that since the creation of the Federal Circuit Court of Appeals, which protects IPR, the balance between IPR and antitrust has moved in an unfavorable direction, i.e. toward alleged property rights and away from competition values.
