The Supreme Court held that resale price maintenance agreements (or vertical minimum price fixing agreements) are no longer per se illegal, but are subject in each case to a full rule of reason analysis.

Bell Atlantic Corp v Twombly
This case has created a movement by pro-consumer organizations to overturn it through the Legislature. Here, the Supreme Court created a brand new requirement that federal complaints must meet in order to overcome motions to dismiss. The Court ruled that the complaint must state enough facts to persuade the presiding court that the claim is “plausible.” Prior to Twombly, the Court had followed a standard set out in 1957 in Conley v. Gibson, 355 U.S. 41 (1957), which said that civil cases should not be dismissed “unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.” This presents a new and very difficult hurdle for antitrust plaintiffs to overcome.
